The Help Bench® – Member Terms and Conditions

1. Acceptance of TermsBy joining and using The Help Bench® ("Community"), you agree to be bound by these Terms and Conditions ("Agreement"). We may update these Terms periodically. Continued participation after such updates constitutes your acceptance of the revised Agreement.2. Membership EligibilityTo join and participate in the Community, you must:
• Be at least 18 years old.
• Provide accurate, up-to-date registration information.
• Use the Community solely for your own business development.
• Not share your membership or account access with others.
The Help Bench® reserves the right to refuse or revoke membership at its sole discretion.
3. Acceptable Use & ConductYou agree to uphold the integrity of the Community and must NOT:
• Harass, bully, intimidate, or discriminate against any member.
• Post or share defamatory, offensive, unlawful, or misleading content.
• Spam, promote, or sell products/services without express written permission.
• Upload viruses, malware, or compromise platform security in any way.
• Dominate discussions, monopolise shared spaces, or misuse community resources.
Examples of violations include (but are not limited to): unsolicited direct messages, affiliate or referral links, unsolicited event invitations, or attempts to recruit members into external programmes or ventures.
4. Zero Tolerance EnforcementWe maintain a strict zero-tolerance policy for breaches of Community standards. If you violate this Agreement, The Help Bench® may, at its sole discretion:
• Terminate your access to the Community immediately, without notice.
• Revoke all participation rights across our platforms.
• Issue a refund solely at our discretion: monthly members may receive a full refund, and annual members a prorated refund, depending on the nature and severity of the breach.
Re-entry following termination is not permitted unless explicitly approved by The Help Bench®.
5. Payments & Cancellations• Membership fees are billed in advance monthly or annually, depending on your selected plan.
• You may cancel your membership at any time via your Stripe customer portal.
• Cancellations must be made at least 72 hours before your next billing date to avoid being charged for the next period.
• No refunds will be issued for past payments except as outlined in Clause 4.
• We reserve the right to revise pricing with at least 30 days’ notice.
6. Session Access & Timetable FlexibilityThe Help Bench® provides live sessions including Peer Sessions, CLEAR Accountability, Expert Q&As, and other community events.
• Sessions are included per your membership tier. Booking is required and places are limited to maintain quality.
• A first-come, first-served system applies. If full, you will be added to a waiting list.
• Inability to book a specific session does not entitle you to a refund, provided the core Community remains accessible.
• We may amend, cancel, or reschedule sessions at our discretion to manage sustainability and demand.
• We will endeavour to expand and improve the timetable in response to community feedback.
7. Intellectual Property• You retain ownership of content you contribute to the Community. By posting, you grant The Help Bench® a non-exclusive, worldwide licence to use, store, and display it for operational and promotional purposes.
• All Community materials, templates, recordings, and resources remain the intellectual property of The Help Bench®. Redistribution, duplication, or sharing outside the Community is strictly prohibited without written permission.
8. Confidentiality• Members are expected to respect confidentiality. “What happens here, stays here.”
• You must not record sessions or distribute others’ content without explicit consent.
• Breaches of confidentiality may result in immediate removal and may be reported to relevant authorities where appropriate.
• While we foster trust, we cannot guarantee confidentiality and participation is at your own discretion and risk.
9. Conflict Resolution Between Members• Where possible, members should attempt to resolve disputes respectfully and directly.
• Unresolved issues must be reported to [email protected].
• The Help Bench® will investigate confidentially and may issue warnings, mediate, or remove members as needed.
• Malicious or false reporting will itself be treated as a violation of this Agreement.
10. Platform & Service Terms• We use third-party platforms such as Heartbeat and Zoom to deliver services.
• We are not responsible for outages, service limitations, or data policies of these platforms.
• By participating, you also agree to the terms and data practices of these platforms.
• We may modify or suspend Community features without prior notice.
• Technical issues with third-party platforms should be directed to their respective support teams.
11. Amendments to TermsWe may update these Terms as needed. Where material changes are made, we will notify members at least 30 days in advance. Continued participation following notice constitutes acceptance of the updated Terms.12. Professional Advice Disclaimer & Expert Services12.1 Nature of Community ServicesThe Help Bench® is a peer support platform offering networking, accountability, and business education. We do not provide professional advice or services.12.2 Expert Participation FrameworkGeneral Education Only• Expert sessions, Q&As, and discussions are educational and informational only.
• No advice shared constitutes formal professional advice.
• No client-adviser relationship is formed via participation.
• Expert Partners share general knowledge and are not acting in a professional advisory capacity within the Community.
Direct Professional Services• To receive formal advice, members must engage Expert Partners through separate, independent arrangements.
• The Help Bench® is not a party to and bears no responsibility for such arrangements.
12.3 Member Acknowledgements & ResponsibilitiesPersonal Responsibility• You make business decisions at your own discretion and risk.
• You are solely responsible for evaluating suitability of shared information.
• Independent professional advice should be sought for legal, financial, tax, or regulatory matters.
Due Diligence• You will verify any information with a qualified professional before implementation.
• You understand that general group advice may not suit your individual circumstances.
• You will not rely exclusively on Community content for critical decisions.
12.4 No Endorsement or GuaranteeExpert Endorsement• The Help Bench® does not endorse, guarantee, or verify the credentials, advice, or services of Expert Partners.
• Their participation does not constitute endorsement.
• Members must conduct their own due diligence before engaging Expert Partners directly.
Content Accuracy• We do not warrant the accuracy, completeness, or currency of information shared.
• Community content may become outdated and is not actively reviewed or updated.
13. Limitation of Liability13.1 Complete Exclusion of Liability
To the fullest extent permitted by law, The Help Bench® (including directors, employees, contractors, and affiliates) shall not be liable for:
Advice & Business Outcomes• Any loss resulting from reliance on advice or content shared by Expert Partners.
• Business outcomes resulting from Community engagement.
• Errors or omissions by Expert Partners.
Community Interactions
• Disputes between members or with Expert Partners.
• Breaches of confidentiality by others.
• Inappropriate or inaccurate content posted by users.
• Technical issues impacting access or participation.
Third-Party Services• Any direct services provided by Expert Partners.
• Disputes, quality, or outcomes arising from third-party engagements.
13.2 Consequential Damages ExclusionUnder no circumstances will The Help Bench® be liable for indirect, special, incidental, or consequential damages, including:
• Lost business or income
• Reputational damage
• Business interruption or downtime
• Data loss
• Substitute service costs
13.3 Maximum Liability CapIf liability is found, The Help Bench®’s total liability shall not exceed the total membership fees paid by you in the 12 months prior to the claim, or £100—whichever is lower.13.4 Mandatory ExclusionsNothing in this Agreement excludes liability for:
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable law
14. Indemnification14.1 Member IndemnityYou agree to indemnify and hold harmless The Help Bench® from any claims, losses, damages, or expenses arising from:
• Use of Community information or services
• Business decisions made through Community participation
• Your breach of these Terms
• Disputes with Expert Partners
• Content you share within the Community
• Any legal or regulatory violations
14.2 DurationThis indemnity survives termination of your membership and the expiry of this Agreement.15. Expert Partner Framework15.1 Expert StatusExpert Partners are independent professionals invited to share industry knowledge. The Help Bench® does not verify or guarantee:• Their professional qualifications
• Their insurance status
• The accuracy of their contributions
• The suitability of their guidance for your needs
15.2 Member Due DiligenceYou are solely responsible for:• Verifying expert credentials and insurance
• Evaluating the relevance and suitability of advice
• Making your own professional decisions
16. General Provisions• Governing Law: This Agreement is governed by the laws of England and Wales.
• Severability: If any clause is found unenforceable, the remainder will remain in full effect.
• Entire Agreement: These Terms constitute the full agreement between you and The Help Bench®.
